1. Introduction

Welcome to CrispBudget (“Service”, “App”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the CrispBudget mobile application and related services.

By downloading, installing, or using CrispBudget, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use CrispBudget. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you must have your parent or legal guardian’s permission to use the Service.

By using CrispBudget, you represent and warrant that you meet these eligibility requirements.

2.2 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3. Service Description

CrispBudget is a personal budgeting application that helps you track expenses, manage budgets, and gain financial insights.

3.1 Core Features

  • Transaction Tracking: Record and categorize expenses and income
  • Budget Management: Set daily budgets and track spending
  • Wallet Management: Create and manage multiple wallets
  • Shared Wallets: Collaborate with family members or partners
  • Reports and Analytics: View spending patterns and insights

3.2 AI-Powered Features

  • Receipt Scanning: Automatically extract transaction data from receipt photos
  • Voice Input: Record expenses using voice commands
  • AI Advisor: Get personalized financial insights through chat

AI features are provided “as is” and may not always produce accurate results. You are responsible for verifying all AI-generated data before relying on it.

4. Account Types

4.1 Guest Account

  • Limited functionality for trial purposes
  • Data stored locally on device
  • AI features: Limited trial usage

4.2 Free Account

  • Full basic functionality
  • Cloud sync with account registration
  • AI features: Monthly usage limits apply

4.3 Premium Account

  • All features unlocked
  • Priority AI feature access with generous limits
  • Wallet sharing and collaboration features
  • See Section 5 for subscription details

5. Subscriptions and Payments

5.1 Premium Subscription

CrispBudget Premium is available as a subscription service:

  • Monthly subscription: Billed every month
  • Annual subscription: Billed once per year (discounted rate)

Prices vary by region and are displayed in your local currency in the App Store.

5.2 Billing

All payments are processed through Apple’s App Store. By subscribing, you agree to Apple’s terms of service for in-app purchases.

5.3 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the end of your paid period.

5.5 Refunds

Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.

5.6 Price Changes

We may change subscription prices at any time. Price changes will not affect your current billing period but will apply upon renewal. We will provide advance notice of price changes.

6. AI Features and Fair Use Policy

6.1 AI Feature Limitations

AI-powered features (Receipt Scanning, Voice Input, AI Advisor) are subject to usage limits:

  • Free accounts: Monthly limits apply (see app for current limits)
  • Premium accounts: Generous weekly limits; displayed as “Unlimited” within fair use

6.2 Fair Use Policy

Our AI features are designed for typical personal use. The following activities are prohibited:

  • Automated access: Using bots, scripts, or automated tools
  • Bulk processing: Excessive usage beyond normal personal needs
  • Commercial use: Using AI features for business or commercial purposes
  • Resale: Reselling or providing AI features to third parties
  • Abuse: Any activity that disrupts service stability

We reserve the right to limit or suspend access to AI features for users who violate this policy.

6.3 AI Accuracy Disclaimer

AI features are provided for convenience and may contain errors. Specifically:

  • Receipt scanning may misread amounts, dates, or items
  • Voice input may misinterpret speech
  • AI Advisor provides general information, not professional financial advice

You are solely responsible for verifying all AI-generated data.

7. User Content

7.1 Your Data

You retain ownership of all content you create or upload to CrispBudget, including:

  • Transaction records
  • Categories and budgets
  • Receipt images
  • Notes and descriptions

7.2 License Grant

By using the Service, you grant us a limited license to process your data solely for the purpose of providing and improving the Service. This includes:

  • Storing and syncing your data across devices
  • Processing images and audio for AI features
  • Generating analytics and insights

We do not sell your personal data or use it for advertising purposes.

7.3 Shared Wallet Data

When you participate in a shared wallet:

  • Other wallet members can view transactions in that wallet
  • The wallet owner controls wallet settings and membership
  • Your private transactions remain private

8. Prohibited Conduct

You agree not to:

  1. Violate laws: Use the Service for any illegal purpose
  2. Abuse the Service: Attempt to disrupt, damage, or gain unauthorized access
  3. Impersonate: Misrepresent your identity or affiliation
  4. Interfere: Disrupt other users’ access to the Service
  5. Reverse engineer: Attempt to derive source code or algorithms
  6. Circumvent: Bypass any security or access controls
  7. Automate: Use bots, scrapers, or automated tools without permission
  8. Commercial misuse: Resell or commercially exploit the Service
  9. Harmful content: Upload malicious code or harmful content
  10. False data: Intentionally enter fraudulent financial information

9. Intellectual Property

9.1 Our Rights

CrispBudget, including its design, features, code, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

9.2 Trademarks

“CrispBudget” and associated logos are trademarks. You may not use our trademarks without prior written consent.

9.3 Feedback

If you provide feedback or suggestions, you grant us the right to use them without compensation or attribution.

10. Third-Party Services

CrispBudget uses the following third-party services:

  • Firebase (Google): Authentication, data storage, cloud functions
  • Google AI (Gemini): AI-powered features
  • Apple: App distribution, payments, authentication

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimers

11.1 “As Is” Service

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY

11.2 No Financial Advice

CrispBudget is not a financial advisor. The Service provides tools for personal budget tracking and general information only. It does not constitute:

  • Professional financial advice
  • Tax advice
  • Investment recommendations
  • Legal or accounting guidance

Consult qualified professionals for financial decisions.

11.3 Service Availability

We do not guarantee that the Service will be:

  • Available at all times
  • Error-free or uninterrupted
  • Free from harmful components
  • Compatible with all devices

11.4 Data Accuracy

While we strive for accuracy, we do not guarantee the accuracy of:

  • AI-generated data
  • Currency conversions
  • Calculations or analytics
  • Synced data across devices

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

12.1 Exclusion of Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data
  • Loss of business opportunities
  • Personal injury or property damage

12.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

12.3 Jurisdiction Variations

Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless CrispBudget and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

14. Termination

14.1 By You

You may stop using the Service at any time. To delete your account:

  1. Go to Settings > Account > Delete Account
  2. Confirm deletion

Account deletion is processed within 30 days. See our Privacy Policy for data retention details.

14.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay subscription fees
  • Have been inactive for an extended period (free accounts only)

We will provide notice when reasonable, except in cases of serious violations.

14.3 Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • We may delete your data according to our Privacy Policy
  • Provisions that should survive (limitations, indemnification) remain in effect

15. Dispute Resolution

15.1 Informal Resolution

Before filing any legal claim, you agree to contact us at support@crispbudget.app and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law

These Terms are governed by:

  • For users in Japan: The laws of Japan
  • For users in the EU/EEA: The laws of your country of residence, plus applicable EU law
  • For users in the United States: The laws of the State of California
  • For users elsewhere: The laws of Japan

15.3 Jurisdiction

Any legal action shall be brought in:

  • For users in Japan: The courts of Tokyo, Japan
  • For users in the EU/EEA: Courts of your country of residence
  • For users in the United States: State or federal courts in California
  • For users elsewhere: The courts of Tokyo, Japan

15.4 Consumer Rights

Nothing in these Terms limits your statutory consumer rights under applicable law.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CrispBudget.

16.2 Severability

If any provision is found invalid, the remaining provisions remain in full effect.

16.3 Waiver

Our failure to enforce any provision does not waive our right to do so later.

16.4 Assignment

We may assign our rights under these Terms. You may not assign yours without our consent.

16.5 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • In-app notification
  • Email (if you’ve provided one)
  • Updating the “Last Updated” date

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.
